Terms of use

This is a translation. In case of discrepancy, the German version prevails.

1. Scope

These terms govern the use of the Papagayo app and its associated services, offered by Jan Milan Eyni (see imprint).

2. Account

Using the service requires an account. It comes into being on your first sign-in through Google or Apple; we do not issue a password. You are responsible for protecting access to the account you use for this – whoever can reach it can also reach Papagayo.

The account is personal and not transferable.

3. The service

Papagayo provides learning cards for the languages offered and adapts repetition to your history. The app works offline; an outage on our side does not stop you from learning.

We continue to develop the service and may change or discontinue features. We announce far-reaching changes with reasonable notice.

We do not warrant any particular availability. We do not owe you a learning outcome.

4. Subscription, price, cancellation

The subscription costs 1 euro per month including VAT. The first month is free of charge. It renews monthly unless cancelled.

The purchase is not made with us. The subscription is concluded as an in-app purchase through Apple's App Store or through Google Play, depending on where you obtained the app. The contract of purchase is therefore between you and that provider, not between you and us. That provider's terms govern the purchase.

Consequently the provider also handles billing, renewal, cancellation and refunds. You cancel in the subscription settings of your Apple or Google account; a cancellation addressed to us has no effect on billing.

These terms govern what you may do with the app and our services. They do not govern the purchase.

After a cancelled or unpaid subscription ends, you may continue to use content already downloaded offline; new content and synchronisation across devices are then no longer available.

5. Withdrawal and refunds

Because the contract of purchase is concluded with Apple or Google respectively (see clause 4), withdrawal and refunds follow their terms and must be claimed there, not with us. A withdrawal addressed to us results in no repayment, because we never received your money.

With Apple this is done at reportaproblem.apple.com, with Google through the order history in your Google Play account.

Your statutory consumer rights towards the respective provider remain unaffected. As the first month is free of charge, no payment arises in the first weeks that could be reclaimed.

6. Your obligations

You will not use Papagayo in a way that disrupts its operation. In particular, you will not call our interfaces automatically beyond the extent of ordinary use. We limit the number of calls per account and suspend accounts that exceed that limit.

7. Content

The learning cards, example sentences, pronunciation data and images are protected by copyright. You may use them within the service, but not redistribute them or make them publicly available.

Part of the content is machine-generated. We strive for accuracy but cannot guarantee it for every card.

8. Suspension and termination by us

We may suspend an account that breaches these terms or endangers operation. For minor breaches we give prior notice where this is possible and reasonable.

9. Liability

We are liable without limitation for intent and gross negligence, and for damage arising from injury to life, body or health. For ordinary negligence we are liable only for breach of material contractual obligations and limited in amount to the damage typical of the contract and foreseeable. Liability under the German Product Liability Act remains unaffected.

For loss of data we are liable only to the extent that the loss would also have occurred had data been backed up properly. Your progress resides on your device; backing it up is your responsibility.

10. Changes to these terms

We may amend these terms and will announce this with reasonable notice. If you do not object, the new version applies; if you object, the subscription ends at the next possible date.

11. Final provisions

German law applies. Mandatory consumer protection provisions of your country of residence remain unaffected.

The European Commission provides a platform for online dispute resolution. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration body.
